These terms govern the use of the bloohawk.com website and the purchase of products through it. By browsing, registering, or placing an order, you fully accept these terms. If you do not agree with any part, do not use the site.

These terms are complemented by the Privacy policy and the Cookie policy, which form an integral part of the agreement between Bloohawk and the user.

3. Products and prices

Bloohawk sells blue light filter glasses and related accessories. The main characteristics of each product are described on its corresponding page.

Prices are displayed in euros (€) and include applicable VAT. Shipping costs, if any, are calculated at checkout before confirming the order.

We reserve the right to modify prices, available products, and promotions at any time, without affecting orders already confirmed.

In the event of an obvious typographical error in the price or description of a product, Bloohawk may cancel the affected order and refund the full amount to the buyer.

4. Order process

The purchase process consists of the following steps:

1. Selecting the product and adding it to the cart.
2. Accessing checkout and providing shipping and billing details.
3. Selecting the payment method.
4. Confirming the order and expressly accepting these terms and the privacy and cookie policies.
5. Processing the payment through our secure provider.
6. Receiving the confirmation email with the order number.

The contract of sale is concluded at the moment payment is confirmed and Bloohawk sends you the confirmation email. Until that moment, no binding contract exists.

5. Payment

Payments are processed through Stripe, a provider certified to the highest security standards (PCI DSS Level 1). We do not store your card data.

The available payment methods are those visible at checkout at the time of confirming the order. They may include, among others, Visa, Mastercard, Apple Pay, and Google Pay.

The charge is made when the order is confirmed. If the payment is rejected, the order will not be processed and no confirmation will be sent.

6. Shipping and delivery

Bloohawk ships to the countries visible at checkout at any given time. Applicable shipping costs and delivery times are displayed at checkout before confirming the order. Times are estimates and may vary due to circumstances beyond our control (holidays, weather, carrier incidents, etc.).

The risk over the products is transferred to the buyer at the moment of delivery, in accordance with applicable consumer protection law.

If the package arrives damaged, is not delivered within a reasonable time, or is lost, contact us at info@bloohawk.com and we will manage the incident with the carrier.

7. Right of withdrawal

As a consumer, you have the right to withdraw from the contract within 14 calendar days from receipt of the order, without justifying your decision and without penalty, in accordance with Directive 2011/83/EU.

To exercise the right of withdrawal, communicate it to us unequivocally before the deadline by sending an email to info@bloohawk.com. You may use the model withdrawal form included below, although its use is not mandatory.

Complete and return this form only if you wish to withdraw from the contract.

The consequences of withdrawal are governed by the provisions of section 8 (Returns and refunds).

8. Returns and refunds

If you exercise your right of withdrawal or if the product has defects covered by warranty, we will refund all payments received, including initial shipping costs (except additional costs if you chose a shipping method other than the cheapest standard delivery).

The refund will be processed without undue delay and, in any case, within 14 calendar days from the date we receive the returned product or, if we request it earlier, from when you have provided us with proof of dispatch of the return.

The refund will be made using the same payment method used in the original transaction, unless we agree otherwise.

Return shipping cost

The direct cost of return shipping (from customer to Bloohawk) is borne by the buyer, except where the product has manufacturing defects or non-conformity, in which case we will assume those costs in full.

As a convenience, Bloohawk may offer you a prepaid return label at the carrier's actual cost, which will be deducted from the refund amount. The use of this label is optional: you may use your own carrier if you prefer, bearing the costs directly.

Alternative to cash refund

As an alternative to the cash refund, we may offer you a voucher redeemable at bloohawk.com of a value higher than the refund amount. The choice is always the customer's; in no case does it replace your legal right to receive the refund in cash.

The specific conditions of the return process (how to initiate it, deadlines, address to send the product) are detailed on our returns page.

The returned product must be in adequate condition (unused or with minimal use necessary to verify it) and with all original components and packaging to a reasonable extent. You will only be liable for the diminished value of the goods resulting from handling other than what is necessary to establish their nature, characteristics, or operation.

9. Warranty

Products sold by Bloohawk are covered by the applicable legal warranty of conformity, as well as a 3-year commercial warranty from the date of delivery against manufacturing defects.

The warranty covers manufacturing and conformity defects. It does not cover wear and tear from normal use, damage from misuse, accidents, unauthorized modifications, or deterioration caused by negligence.

To claim the warranty, write to us at info@bloohawk.com with your order number, a description of the defect, and, if possible, photographs of the product. We will indicate the procedure to follow.

10. Liability and limitations

We are liable for the conformity of the products sold and for compliance with the terms of sale, in accordance with applicable legislation.

We shall not be liable for damages or losses arising from circumstances of force majeure, fortuitous events, acts of third parties, or improper use of the product by the buyer.

Except where prohibited by law, Bloohawk's total liability to the buyer shall not exceed the amount actually paid for the affected order.

11. Intellectual property

All content on the bloohawk.com site — including, without limitation, texts, images, photographs, illustrations, logos, trademarks, code, and design — is the property of Bloohawk or its licensors and is protected by applicable intellectual and industrial property legislation.

The reproduction, distribution, modification, or public communication of any content without prior written authorization from Bloohawk is prohibited, except for personal and private use.

12. Use of the website

You agree to use the website in good faith and in accordance with these terms, applicable legislation, and respect for the rights of Bloohawk and third parties. In particular, you agree not to perform the following actions:

• Access the site or its systems without authorization.
• Place fraudulent orders or with false data.
• Use the site for illegal activities or those that harm the rights of third parties.
• Introduce viruses, malware, or any code that may damage the site or its users.
• Carry out automated scraping, reverse engineering, or unauthorized commercial use of the content.

We reserve the right to deny access to the site or cancel orders in case of breach of these terms.

13. Privacy and cookies

The processing of personal data you provide is governed by our Privacy policy. The use of cookies is governed by our Cookie policy. Both form an integral part of these terms.

14. Modification of terms

Bloohawk may modify these terms when it deems necessary, for example to reflect legal changes or changes in its services. If the changes are substantial, we will notify you with reasonable advance notice through the site or, if applicable, by email.

The modified terms will apply to orders placed after their entry into force. Orders in progress are governed by the version in force at the time of their confirmation.

15. Applicable law, jurisdiction, and dispute resolution

These terms are governed by Spanish law. For any dispute arising from the use of the site or the purchase of products, the parties submit to the courts of the consumer's domicile, in accordance with Regulation (EU) 1215/2012 and Regulation (EC) 593/2008 (Rome I).

In accordance with Regulation (EU) 524/2013 on online dispute resolution, we inform you that the European online dispute resolution platform (ODR) is available at https://ec.europa.eu/consumers/odr/.
